Request for referendum approval for SCAOPI 2026-01
TO ALL QUALIFIED VOTERS WHO HAVE THE RIGHT TO BE REGISTERED ON THE REFERENDUM LIST FOR ZONE VI-10 AND THE CONTIGUOUS ZONES VI-9, RU-10 AND RU-15 OF THE MUNICIPALITY OF THE TOWNSHIP OF GORE:
PUBLIC NOTICE is given of the following:
Following the public consultation held on April 20, 2026, on the first draft resolution concerning SCAOPI 2026-01 for the construction of an access road and a parking area on lot 5 081 112 located on Hazlett-Hicks Road, in zone VI-10, the municipal council adopted the second draft resolution concerning this project at its meeting held on May 4, 2026.
This second draft resolution aims to authorize, subject to certain conditions, the construction of a driveway at 10 metres from a watercourse by reducing the depth of the shoreline, thus derogating from the definition provided for in Zoning By-law No. 214 as well as article 153 of the same by-law. The application also seeks to authorize the construction of said driveway prior to the filing of a new residence permit application, which is in violation of article 98 of Zoning By-law No. 214.
REQUEST FOR REFERENDUM APPROVAL
This second draft resolution contains a provision that may be the subject of a request from interested persons in zone VI-10 and the contiguous zones VI-9, RU-10 and RU-15, asking that this resolution be submitted for their approval in accordance with the Act respecting elections and referendums in municipalities.
More specifically, the provisions of SCAOPI 2026-01 concern the construction of a driveway and a parking area on lot 5 081 112 located on Hazlett-Hicks Road, in zone VI-10, and are intended to allow the project in accordance with the derogatory parameters applicable to this file.
Interested persons may submit a request to have this resolution presented for approval by the qualified voters in the zone to which it applies and in any contiguous zone from which a valid request originates.

CONDITIONS REQUIRED FOR A VALID REQUEST
To be valid, any request must:
- Clearly indicate the provision to which the request relates and the zone from which it originates;
- Be signed by at least 12 interested persons from the zone from which it originates or by at least the majority of them if the number of interested persons in the zone is 21 or less;
- Be received by the municipality, at the office located at 9 Cambria Road in Gore, no later than the 8th day following the publication of this notice.
CONDITIONS TO BE MET IN ORDER TO HAVE THE RIGHT TO SIGN A REQUEST:
IS a qualified voter:
Any person who, on May 4, 2026, meets the following conditions and is not disqualified from voting under section 524 of the Act Respecting Elections and Referendums in Municipalities, and meets the following:
- Is a natural person domiciled in the Municipality of the Township of Gore
- Has been domiciled in Québec for at least 6 months
- Is of legal age
- Is a Canadian citizen
- Is not under curatorship
Any owner of an immovable or occupant of a business establishment who, on May 4, 2026, meets the following:
- Has been the owner of an immovable or the sole occupant of a business establishment located within the Municipality of the Township of Gore since at least May 4, 2026.
- If a natural person: must be of legal age, a Canadian citizen, and not under curatorship
In the case of undivided co-owners of a building or co-occupants of a business establishment:
- Be an undivided co‑owner of the immovable or co‑occupant of the business establishment since at least May 4, 2026.
- Be designated, by power of attorney signed by the majority of co-owners or co-occupants who are concerned parties and established since at least May 4, 2026, as the person entitled to sign the register on their behalf. The power of attorney must be submitted in writing before or during registration
In the case of a legal person:
- Be designated by resolution of its members, directors, or employees
- On May 4, 2026, is of legal age, is a Canadian citizen, and is not under curatorship
Except in the case of a person designated as a representative of a legal person/entity, no one may be considered a qualified person to vote in more than one capacity, and this, in accordance with section 531 of the Act respecting elections and referendums in municipalities.

ABSENCE OF REQUESTS:
If the resolution has not been the subject of a valid request, it will not have to be approved by the qualified voters.
